The Commodity Futures Trading Commission is soliciting public feedback on how to regulate derivatives contracts linked to computational power used in artificial intelligence infrastructure. This step reflects the agency's effort to develop a regulatory framework as compute resources—particularly GPUs—have emerged as tradable assets with derivatives markets developing around them.
Compute-based derivatives represent a new asset class distinct from traditional crypto derivatives tied to tokens. As computational capacity has become increasingly scarce and strategically valuable, spot markets, reserved capacity markets, and derivatives instruments have begun forming around GPU availability and pricing.
