The Office of the Comptroller of the Currency released a final rule implementing the GENIUS Act on October 21, 2026, establishing a federal regulatory framework for payment stablecoin issuers operating under OCC supervision. The rule covers permitted payment stablecoin issuers and foreign payment stablecoin issuers, along with custody activities by OCC-supervised entities, and takes effect January 18, 2027. U.S. Secretary of the Treasury Scott Bessent characterized the GENIUS Act as a watershed moment establishing digital-age payment infrastructure comparable to the National Currency Act of 1863.
The final rule specifies standards for reserve backing, redemption mechanisms, and risk management but does not yet address Bank Secrecy Act, anti-money laundering, or Office of Foreign Asset Control sanctions requirements. Those provisions will be handled through separate Treasury-coordinated rulemaking. The OCC indicated it received hundreds of public comments during the proposal phase from crypto companies, community banks, trade associations, and academics before finalizing the framework.
The agency has not yet announced when it will begin processing applications from prospective stablecoin issuers. The OCC stated it will monitor industry development closely and adjust the supervisory framework as needed given the nascency of the sector.
