CFTC Chair Mike Selig indicated the agency plans to establish its own regulatory framework for crypto markets if legislative efforts stall, drawing on powers already available to the agency under existing law. Selig noted that staff have been tasked with developing rules that would create a specialized "crypto asset DCM" designation, permitting both currently registered and unregistered crypto exchanges to offer leveraged or margined trading within CFTC oversight.
The move signals a fallback pathway for market structure regulation that does not depend on Congressional passage of the CLARITY Act. According to remarks made at the Innovation Advisory Committee on August 21, Selig stated the CFTC would move to propose these rules promptly if legislative stalling continues.
The timing and specific form of any unilateral CFTC action remain unclear, as does the scope of assets or trading venues that would qualify under a "crypto asset DCM" framework. It is not yet known how existing regulatory bodies or market participants might respond to such designations, or whether Congressional action on separate legislative efforts might outpace or preempt agency rulemaking.
